Subcontracting Minimum Requirements

Vehicles are required to be of a type customarily used in the cable or telecommunications industry for the Work to be performed, and be clearly identified as being operated by the Subcontractor by signs or lettering on both front side door panels and other mutually acceptable locations on the Vehicles.

All vehicles utilized by the Subcontractor in its performance of the Work (“Vehicles”) must be operated by only licensed operators, and meet minimum standards without limitation.  Subcontractors are required to observe and comply with all applicable federal, state and local safety Rules and regulation including, the Occupational Safety and Health Act (“OSHA”).

Vehicles shall be equipped with standard OSHA required safety devices as listen in the OSHA Handbook and must meet D.O.T. requirements

Commercial Automobile Liability Requirements:

Commercial Automobile Liability to include all Owned, Leased, Hired, and Rented Automobiles. Hired/Non-Owned Auto, Personal Injury Protection and Uninsured Motorist Coverage is also required.

Limits of Liability shall not be less than: $1,000,000 Combined Single Limit for Bodily Injury and Property Damage.

A Subcontractor is also required to add Absolute Underground, Inc. as an additional insured per CG 20 (11/85)




A Subcontractor is required to maintain throughout the term of the Subcontract policies of insurance from a carrier with A.M. best rating of “A-” of better. Subcontractor is required furnish Absolute Underground, Inc. with a Certificate of Insurance including a 30 day written notice of cancellation.

The Certificate of Insurance must include coverage and minimum limits as follows:

Workers Compensation:
Statutory, Including Employer’s Liability for a limit not less than:
$500,000 Each Accident, $500,000 by Disease and $500,000 Policy Limit.

Commercial General Liability:

Commercial General Liability Coverage to include Premises Operations Coverage, Written on “occurrence” form,

Independent     Contractor’s Coverage, Products/Completed Operations Coverage, and Broad Form Comprehensive

General Liability Endorsement, Per Project Endorsement with limits less than:

$1,000,000 Combined Single Limit for Bodily Injury and Property Damage and $2,000,000 General Aggregate.

Subcontractor’s workers compensation/employers liability, general liability and automobile liability policies of insurance must be written by an insurance company satisfactory to Absolute Underground, Inc., the general liability and automobile liability name must name the Contractor and the Customer as additional names insured, and all policies shall expressly provide that the policies are not subject to material change or cancellation without at least thirty (30) days prior written notice to Contractor.

All policies shall be endorsed to provide a waiver of subrogation in favor of Contractor. All policies shall be endorsed to provide a waiver of subrogation in favor of Contractor; its parent and affiliates, employees, directors, and officers, other subcontractors and the Customer.

Subcontractor shall maintain the following policies of insurance:

Workers compensation
For the protection of its employees, as required by applicable law, and of not less than:Five Hundred Thousand Dollars ($500,000.00),

General liability insurance
Must contain a contractual liability coverage specifically covering the indemnity provisions in this agreement with a per occurrence limit of:
One Million Dollars ($1,000,000) for bodily injury and property damage combined.

The aggregate limits must be at least Two Million Dollars ($2,000,000) for property damage, and bodily injury combined.

Automobile liability insurance
On all owned, hired or non-owned vehicles, including mobile equipment used to perform services for Contractor with per occurrence limits of not less than:
One Million Dollars ($1,000,000) for bodily injury and property damage combined.
